- MoD was in possession of information containing the names and personal details of people under the Afghan Relocation and Assistance Policy (ARAP) scheme.
- The list containing the information was emailed in error to at least a dozen people, one of whom is believed to have posted that sensitive information on social media.
- The information shared contained details of anyone, including their family members, whom are considered enemies of the opposing factions.
- Information breached included names, email addresses, family details, MoD-assigned reference numbers, personal details and their role in the Afghan army.
- The breach has caused a significant threat to life for people who are based in Afghanistan, and also those who are based abroad.
- Barings Law has received instructions from nearly 1,000 individuals and fought for the super-injunction to be removed and those included in the breach to be informed.
- The MoD took out a super-injunction when the media became aware of the breach. This prohibited any mention of the issue.
- The MoD has tried to supress the data breach for nearly three years by taking out a super-injunction.
- The breach, which was caused by an email error, happened in 2022. Since then, the Ministry of Defence have made efforts to keep the incident a secret.

Can my family submit a claim if their details were breached too?
Yes. If your family members also had their personal details breached, they are eligible to submit a claim. Each individual will need to complete their own claim form and sign a separate Conditional Fee Agreement. They must also provide your Ministry of Defence assigned reference number so we can link cases together and manage the files more efficiently.
What information do I need when submitting a claim?
When submitting a claim by completing our quick and easy form, we simply require some information about you. This includes your name, date of birth, country of residence, and contact information so we can get in touch regarding your case.
You’ll also be asked to provide your Ministry of Defence assigned reference number. If you don’t have it to hand, our team will be in touch to help you with this step.
What fee do Barings charge?
If we are successful in your claim, Barings Law charge a success fee of 35% + VAT. These fees will be displayed in your No-Win No-Fee Agreement.

When news of the breach surfaced, the Ministry of Defence obtained a super-injunction preventing any mention of the incident.
