What can you claim for if you were granted credit you could not afford?

If your repayments were unaffordable, or if meeting those payments meant you experienced severe hardship, you may be a victim of irresponsible lending. You must look at:

Affordability check failures

If your broker or lender did not examine your ability to repay what they offered you, they failed in their duty to act in your best interests. If they were motivated by their fees, that creates a conflict of interest and provides grounds for you to pursue compensation.

Severe hardships for the customer

You were mis-sold your loan or other financial product if you could not afford to pay the debt on time, in full, and without having to borrow further or falling behind on any other loans or financial commitments.

Secured loan mis-selling

Granting loans or credit on a larger scale than was needed, leaving customers with debts they find difficult to pay in full and on time without having to borrow more money or cutting back on essential living costs.

What information do I need when submitting a claim?

When submitting a claim through our quick and easy online form, we will require:

  • The details of the lender you believe to be irresponsible
  • The date of the financial product you purchased
  • Details of the amount you borrowed and what effect it had on you

What fee do Barings Law charge?

If we are successful in your claim, Barings Law charge a success fee. This will be no more than 30% or £10,000 (excluding VAT), whichever is lower. These fees will be displayed in your Conditional Fee Agreement. We work on this basis in order to significantly reduce the risk of a client facing a bill for legal fees in instances of unsuccessful claims. All we ask is that you are honest and cooperative throughout as we carry out your instructions.

What do I have to pay if my claim is unsuccessful?

If we are unsuccessful in your compensation claim it is highly unlikely that you will receive a bill for our services, providing you have cooperated with us at every stage of your claim. There are virtually no circumstances in which we will charge a client in the event of a claim being unsuccessful.

How long does the process take?

Each Irresponsible Lending claim is unique, meaning we cannot provide a specific timeframe at the outset. However, our team will keep you updated throughout the process, and will be able to give you more specific details as they work on your claim. 

I no longer live with the person I took out the loan with, can I still claim?

You can still make a compensation claim if you shared responsibility for the repayments of a loan or finance agreement with someone you no longer live with.

The lender I used for the loan with has ceased trading, can I still claim?

If the lender with whom you took out the loan is no longer trading, you are still eligible to submit a claim.
