How has the claim against St. James’s Place come about?

St. James’s Place has recently been criticised for charging customers ongoing advisory fees to provide annual reviews of their financial products and allegedly not providing the service. Subsequently, St. James’s Place have confirmed that they have set aside £426m to pay refunds to clients who paid its ongoing advisory fees but did not receive an acceptable level of service for the fees charged.  

Who can claim?

If you were a customer of St. James’s Place within the last 10 years and suspect you were charged for ongoing advisory fees, inadequately informed about fees and/or provided with unsuitable advice. You may also be eligible to submit a claim if you suffered a financial loss due to a mis-sold pension or investment.

What information do I need to provide to start my claim?

In order to start your claim, please fill in our claim enquiry form and provide us with any supporting documents you have, such as terms and conditions and annual statements. Please do not worry if you have not retained any documents – we still may be able to help you and obtain the relevant documents on your behalf.

How long does the process take? 

The process will vary for each individual claim. Once we have determined the eligibility of your claim, we will draft the necessary paperwork and submit your complaint directly to St. James’s Place. We anticipate the claim journey to take approximately three to six months. However, this may vary depending on the outcome of your complaint and whether there is a need to refer your complaint to the relevant Ombudsman service for further review and consideration.

What fee do Barings charge?

If we are successful in your claim, Barings charge a success fee of 25% + VAT. These fees are displayed in the Conditional Fee Agreement we ask you to sign at the outset of your claim. If you have cooperated with our legal teams and your claim is unsuccessful, it is highly unlikely that you will be liable for any fees.

Will I be charged if my claim is unsuccessful? 

If we do not win your claim on your behalf, there are virtually no circumstances in which you would have to pay us for our legal services. All we ask is that you are honest, open and truthful throughout the process, and that you cooperate with our operatives should the need to supply documents or further information arise.
